Acceptance of Terms By submitting this application and participating in The Pup Pop Up on December 5th, 2026 at Pine, Vendor agrees to comply with all event rules, regulations, and directions issued by Event Host (Reflections by Rhiannon).
- Assumption of Risk and Release Vendor acknowledges that participation involves inherent risks. Vendor, on behalf of itself, its employees, agents, contractors and guests, releases, waives and discharges Event Host, its officers, directors, employees, volunteers, contractors and agents (collectively “Released Parties”) from any and all claims, liabilities, losses, damages, costs or expenses (including attorney’s fees) arising from injury, loss, theft or damage to person or property related to Vendor’s participation, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.
- Indemnification Vendor shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, demands, liabilities, losses, damages, judgments, costs and expenses (including reasonable attorney’s fees) arising out of or resulting from Vendor’s acts, omissions, operations, products, services, booth activities, employees, agents, contractors or invitees, including claims arising from Vendor’s negligence, except to the extent such claims are caused by the gross negligence or willful misconduct of the Released Parties.
- Compliance and Safety Vendor agrees to comply with all applicable laws, health and safety codes, fire regulations and event rules. Vendor is responsible for securing and properly maintaining its booth, equipment and displays and for obtaining any required permits, licenses or sales tax registrations.
- Property and Loss Vendor is solely responsible for loss, theft or damage to Vendor’s property and inventory.
- Right to Refuse/Remove Event Host reserves the right, in its sole discretion, to reject any application, to refuse admission, or to remove any vendor, staff, merchandise, displays or attendees for violation of rules, unsafe conditions, unlawful activity or conduct deemed inappropriate by Event Host. No refund shall be required if Vendor is removed for cause.
- Photography, Video and Publicity Vendor grants Event Host a royalty-free, perpetual license to photograph, record, reproduce and use images or recordings of Vendor and Vendor’s booth for promotional, archival or commercial purposes unless Vendor provides written notice to the contrary prior to the event.
- Force Majeure and Cancellation: Event Host shall not be liable for delays, cancellation, or failure to perform caused by events beyond its reasonable control (including, without limitation, acts of God, government orders, strikes, pandemics, weather, or public safety concerns). In such cases, Event Host’s liability is limited to refund of fees paid, if any, at Event Host’s sole discretion.
Acknowledgement By signing below, Vendor certifies that it has read, understands and agrees to the terms above.
